BIG SUIT DISMISSED.


Suit of the Over Glass Co., of Muncie, Against

the L. E. & W. Ry. at an End.


The suit of C. H. Over, window glass manufacturer, against the Lake Erie and Western Railway Co., for damages, in all amounting to about $200,000, was settled in the United States court in Indianapolis on May 22 by compromise, each party agreeing to pay his own costs and drop the suit.

The litigation was the result of the fire that destroyed the Over and Hemingray glass factories three years ago.

It was claimed that the fire started in the Over factory from a spark from an L. E. & W. switch engine which was at work near the factory at the time and that the fire was then carried to the Hemingray factory in an opposite direction.

The two companies secured their insurance from about 20 companies involved in the losses and the suit was really begun by the insurance people as they were the losers.
