$200,000 Suit Between Over and the

L. E. & W. Out of Court

By the mutual agreement of the parties interested the suit of the C. H. Over Window Glass company to recover about $200,000 from the Lake Erie and Western railroad company was dismissed day before yesterday, each side paying its own costs. This suit grew out of the de­struction by fire of the factory, owned by the complainants and the Hemingrays about three years ago.

The complaint which was filed in the United States court, and which came be­fore Judge Bauer for trial, alleged that the firm, by which the two factories were destroyed, started by reason of a spark from an engine owned by the defendant company. After the fire the insurance on the two factories was adjusted and paid and then the insurance people brought suit against the railroad company in the name of the owners of the destroyed factory.

The terms upon which the com­promise agreement was made are un­known. When dismissed all that was learned was that each side paid its own costs, but as to whether the railroad company came down with some coin nothing is known.
