James L. Stevens, aged 39, and James M. Stevens, aged 70, his father, resid­ing at 117 West Fifth street, had a fight this morning which resulted in serious injury to the younger man. In the melee the old man bit his son’s ear causing & very painful wound. Stevens, Jr., came to police headquarters and desired to file an affidavit against his father. He claims that he returned to his home at about 12 o'clock and that father was enraged at the lateness of the hour and attacked him in a vicious manner, — hitting him with a chair and biting his ear.

The older Stevens claims that his son came home partly intoxicated and made a brutal assault upon him knock­ing him down twice. He says that he bit his son only to escape serious injury.

The old man is a soldier and draws $24 a month pension. He has been living with his son who is employed at Hemingray’s glass factory. The fath­er pays the house rent for his board. Recently the senior Stevens secured permission to have one of his daugh­ters, who is in the Orphans Home here return to him. As there is some contagious disease at the home the girl could not come for a day or two. It is said that Mrs. Stevens, the wife or the younger man, confirms the older man's statements. No arrests were made.
