A telephone message from Indianapolis to the Times this morning ask­ed whether interested persons intend­ed to prosecute Eugene ("Bobby") Hart, the Muncie polo player, on a charge of perjury because of his con­nection with the Hemingray-Cusick marriage that created so great a sensation yesterday. The informant said that Hart made an affidavite [sic] affidavit in the of­fice of the Marion county clerk that Miss Hemingray had lived in Marion county for 30 days previous to the date of issuing the marriage license, when she had not been living there at all.

As far as known, no action will be taken by Muncie people to prosecute Hart on the charge, though he is open to action on the part of the state if the prosecutor of Marion county or any other officer care to take the mat­ter up. Perjury is a penitentiary offense. The marriage license to Miss Hemingray and David Cusick was re­fused in Delaware county for the rea­son that the young woman had not been a resident of Delaware county for 30 days last past.

Cusick and his wife whom he won in so sensational a manner, departed from Indianapolis for Kokomo this morning where they will continue to live.

The marriage service was read at the Imperial hotel in Indianapolis last evening at 8 o'clock. Rev. Joshua Stansfield, of the Meridian Street M. E., church, being the officiating clergy­man. Soon after the ceremony, the bridal pair went to English's theatre where they witnessed the production of "The Maid and the Mummy." Mr. and Mrs. Eugene Hart acted as their companions and witnessed the marriage ceremony. The only other wit­ness besides the minister was William Poor, proprietor of the Imperial hotel.

Mrs. Anna Hemingray, mother of the young woman, whose objections to the marriage proved unavailing, is now in St. Louis when she was joined by her son, Robin, Mrs. Hemingray was accompanied by Miss Kate McDowell, the close friend of her daughter.

There has been no incident of a social nature recently that has caused as wide comment as the marriage yesterday under dramatic circumstances of Miss Hemingray, the young society girl and member of a prominent fam­ily, to David Cusick, a polo player.

David Cusick is popular with the polo "fans" in all parts of Indiana and has many friends here.

 

KNOWN IN COVINGTON.

 

The Cincinnati Commercial-Tribune said, this morning:

"Miss Hemingray is widely known in Covington, Ky. She lived there until three or four years ago, and during that time was one of the popular society girls of the city. Since moving to Muncie she has frequently visited in Covington, where she is always welcomed by a large circle of friends and admirers.

"Miss Hemingray is a niece of Bradford Shinkle and Daniel Hemingray also of Covington. Her mother before her marriage was Miss Fanny Timberlake, of Newport, thus connecting her on both sides with the best families of Kentucky.

"Several months ago come the announcement of Miss Hemingray's engagement to a prominent business and society man of Muncie, Ind, but recently friends of the family have been informed that it was suddenly broken.

"Previous to this there was a rumor to the effect that Miss Hemingray to wed a St. Louis turfman, a of her brother, Robert Hemingray."
