Justice Sherman Orders a Verdict for

$5686.66 Against E. N. Righley et Als.

Today Justice Sherman ordered a verdict in the case of Hazen M. Chase, administrator of the estate of William Hales, against E. N. Highley and others in the second session of the Superior Court.

This was a suit on a promissory note for $4000, made by the defendants, Nov. 15, 1884, payable to the order of the plaintiff’s intestate.

The defence was that the defendants gave the deceased shares of stock in the Ameri­can Iron, Glass Plate and Pipe Company, which was worth at the time the note matured, $4800, but the plaintiff’s intestate through negligence allowed the collateral to depreciate in value. A further defence was that the deceased promised to forbear suing the defendants until a suit which they had brought against another party had been decided.
