Victor Morton sues A. L. Dyke for $650.

Victor I. Morton began suit Monday against Acteon L. Dyke, the well known marble man, alleging on the part of the defendant a breach of contract. In his petition he recites that on Jan. 20, 1899, he entered into a contract with A. L. Dyke, by virtue of which he was to superintend the works of the defendant and for so doing was to receive $75 per month and 5 per cent. of the net profits of the business done by the defendant. He states that he did as contracted until July 31, 1891, when the defendant sold out to the American Marble and Toy Co. He states that during this interval the profits of the defendant from the business were $13,500, but that he never received, as per contract, any of the $675 due him from these profits except $25 on account. He asks for judgement for the remaining $650.
