The case of the Consolidated Fruit Jar Co., of New Brunswick, N.J., and the Hero Fruit Jar Co., of Philadelphia, against Isaac E. Wormser and Wormser & Co., of this city, for infringement of a patent on a fruit-jar cap and trade-mark, came up for final hearing on Wednesday last before Judge Acheson in the United States Circuit Court. A temporary injunction was granted against the defendants some time ago, as will be remembered by readers of the JOURNAL. At the reopening of the suit arguments were begun, and as there was a large and distinguished array of counsel to be heard consisting of Messers. W.C. Wittier and W.H. Kenyon, of New York, and Cousten Brown, of Boston, on behalf of the plaintiffs, and Messers. Dyer, of Boston and Lysander Hill, for the defendants, the case was not concluded.
