C. H. Over & Company File a New Suit

Against the L. E. & W.


The case of the C. H. Over window glass company against the Lake Erie & Western railroad for $100,000 damages mention of which was made exclusively in yesterday's Times is one that involves several insurance companies also. On June 18, 1892, the Over and the Hemingray glass factories were destroyed by fire, involving an aggregate loss of $240,000. Subsequently the Over company brought suit against the L. E. & W. railroad company for $75,000, alleging that the fire originated from a spark from a Lake Erie engine.

On account of a failure on the part of the plaintiff to comply with the rules of the court the case was transferred at the instance of the defendant to the United States court at Indianapolis. The plaintiff being desirous of having the case tried in the Delaware circuit court has filed another complaint, changing the amount to $100,000.

The insurance companies that carried policies in the factories burned are: British American, Niagara, Sun Fire office, Manchester, Norwich, North British Mercantile, Firemen of Baltimore, Western, Traders, German of Peoria, St. Paul Fire and Marine, Lancashire, Imperial, Home, Evansville, Caledonia, Indiana Underwriters of Fort Wayne, Springfield Fire and Marine, Scottish Union, Redding, Hamburg Breman, State Investment company, making a total of $43,300 insurance on the Over glass factory alone.

The Hemingray company carried $31,500 insurance. If the Over company is successful in their suit against the railroad company the Hemingray company will likely bring suit for damages also. The glass companies will be assisted in the suit by the Insurance companies.
