Ohmer, son of Orville Beeth, filled an affidavit against Bob Hemingray for assault and the latter was tried before Behymer last evening and acquitted. The witnesses all testified that Mr. Hemingray ordered Ohmer out of the factory and not going he was led out by the arm, in a gentlemanly way.
