J.B. Sullivan vs. The Ohio Valley Glass Co. Suit on cross petition by the receiver of the Glass Co. to set aside a mortgage of $4,000 on the property of the Glass Co. on the ground that it was in fraud of subsequent creditors. This mortgage was claimed to be valid because all stockholders agreed to it and it was properly recorded in the Recorder's office before these creditors became such. The common pleas, on demurrer, held the mortgage valid; and, on appeal, the circuit court, by Judge Cook, rendered the same decree. Black for Receiver; Turnbaugh & Eagleson, for mortgagee.
