For the past week Judge Dunwell has been presiding over a case in Ontario county, that of the Locke Insulator Company against Fred Locke. The defense had rested their case, and both sides summed up before the Judge in chambers here Saturday. Decision was reserved by the Court. The case is regarding various patents which the plaintiff maintains were included among those bought from the defendant at the time the company was formed.

In summing up, the counsel for the plaintiff laid emphasis on certain phrases in the contracts drawn up by the company and the defendant, and said that shrewd business men certainly would not have invested their money in a deal in which patents were withheld by which the man holding them could "throttle the business." He said that when the negotiations were being conducted it was understood that the wording of the contracts, which were to the effect that all patents connected with the business should be turned over to the company, was to guard against such an occurrence. The plaintiff was represented by W. S. Hubbell. W. H. Bowman representing the defendant, in summing up said that the patents referred to were not connected with the business at that time, and Mr. Locke did not understand it so.
