No:2883. Shepard Robbins vs. Joseph L. Proctor. This action is to recover a balance of about $375 for coal alleged to have been sold and delivered to the defendant, carrying on business under the name of the Boston Bottle Works. The coal was purchased by Samuel Oakman, and the plaintiff contended that Oakman was the agent of the defendant, who was responsible as an undisclosed principal. The only question in the case was whether the defendant was responsible for the coal. Jury out.
