Vice Chancellor Walker

Refused to Confirm Receiver's

Action Creditors Win

 

Vice Chancellor Walker has filed in the Court of Chancery his memorandum in the suit of William H. Willimas against the Globe Pottery Company. The Vice Chancellor refuses to confirm the recent sale of the pottery plant at White Hill, by Charles B. Case, receiver.

The offer to purchase was made by John Cochran, George Cochran, David Allen and William H. Williams, the complainant. Their tender was $50,000 for the real estate and $2,500 for the personal property.

The memorandum of Vice Chancellor Walker states that opposing creditors objected to the confirmation of the sale, on the ground that the price was inadequate; also that an order made by the court permitting the bidders to use their bonds, secured by a mortgage on the pottery, to the extent of $50,000, was made without notice to them; also that the statute under which the sale was ordered to be made, free from encumbrances, requires that the sale should be made for cash only.
