THE Equitable Life Insurance Company of New York are the plaintiffs in a suit in the Essex County Circuit Court, N. J., against Frederick A. Duggan, proprietor of the Imperial Porcelain Works of Trenton, for the payment of premiums on a $100,000 life insurance policy. Mr. Duggan bases his defense on the alleged misrepresentation made by the company's agent. He says that he agreed on a certain kind of policy, but the policy he received was not what he agreed upon, and he returned it to the Trenton agent and notified him that he could not accept the terms.
