Provisions of the "Anti" Measure

Which Governor Hanly Has

Signed and Isa to Become

a Law.

Indianapolis, March 1. — There is much comment over the fact that Governor Hanly signed the Parks anti-cigarette bill. As the bill has no emergency clause, the act will not be effective un­til all of the acts are published, about June.

According to the author, Senator Parks, there is only one way whereby a cigarette can be smoked and that is by using some tissue paper other than that manufactured for the specific purpose

of being made into a cigarette. There seems to be some question as what might be construed to constitute "cigarette paper" within the meaning of the act. It is not thought that attempt will be made to enforce the literal provisions of the act, but in that it will make harder the purchase and use of cigarettes by minors the act is thought by some to be a good measure.

The act follows in full:

Section 1. Be it enacted by the gen­eral assembly of the state of Indiana, that it shall he unlawful for any per­son, by himself, clerk, servant, em­ploye or agent, directly or indirectly, upon any pretense or by any device, to manufacture, sell, exchange, barter, dispose of or give away, or keep for sale, any cigarettes, cigarette paper cigarette wrappers, or any paper made or prepared for the purpose of being filled with tobacco for smoking, or keep or own, or be in any way concerned, engaged or employed in owning or keep­ing any such cigarettes, cigarette paper or wrappers, and any person for vio­lation of the same shall be guilty of a misdemeanor, and upon conviction shall for the first offense pay a fine of not less than $25 nor more than $50 and cost of prosecution, find stand committed to the county jail until such costs are paid, and for the second and each subsequent offense he shall pay, upon conviction thereof, a fine of not less than $100 nor more than $500 and the costs of prose­cution, or be imprisoned in the county jail not to exceed six months; Provided, That the provisions hereof shall not ap­ply to the sales of jobbers doing an interstate business with customers out­side the state.

Sec. 2. All laws and parts of laws in conflict with this act are hereby re­pealed.
